Clob Terms & Conditions

1. Scope of Application of Clob
These Terms and Conditions (the "Agreement") govern the use of Clob (formerly Bondi) and its related services, which include, but are not limited to, the mobile application, the web application, and any other related service that Clob may offer from time to time. Henceforth, all references to 'Clob' include all of these services.
This Agreement applies to the use of Clob and the services or features contained within it for its users, through any medium by which access to the platform can be made. Clob, its content, and functionality, belong to the company Bethere SpA, RUT 77.878.736-9, an existing company constituted under the laws of the Republic of Chile, operating under the commercial name "Clob."
Clob provides information, messaging, and event management tools for public and private communities, allowing all users ("users") to participate in events organized by other users on the platform. Any person who uses Clob is considered a user. However, only those users who have created a profile on the platform have the ability to organize events ("organizer"), using the spaces and functionalities that Clob provides. Users can choose to organize events, attend events organized by others, or both.
For paid events, Clob allows connection with other recognized and existing payment platforms in the market.
2. Acceptance of Terms and Conditions
By accessing or using Clob, you agree to be bound by the terms and conditions set forth in this Agreement. If you do not agree with all the terms and conditions of this Agreement, you may not use Clob. Clob reserves the right to modify this Agreement at any time, and such modifications will take effect immediately upon the publication of the modified Agreement on the platform. Your continued use of Clob after the publication of the modified Agreement will constitute your acceptance of the modified terms and conditions.
The acceptance of these Terms and Conditions constitutes an explicit acknowledgment of having read the content in its entirety, understanding its scope and meaning as a commitment to comply, without reservations, modifications, or conditions of any kind, and assuming full legal responsibility concerning these Terms and Conditions.
3. Clob Users.
3.1. General Conditions
The Clob platform allows all "users" to access information about public events and participate in them. Private events, however, will only be accessible to users who receive a private link or a specific invitation. For both public and private events, the organizer has the option to require prior approval before allowing participation. To create and manage events, users must complete a profile on the platform under the conditions, guarantees, and information required by it.
Users, regardless of whether they organize events or not, may not under any circumstances:
- Use the platform for purposes other than those outlined in these Terms and Conditions.
- Manipulate, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, attempt to discover any source code, reverse engineer, decompile, disguise, or otherwise exploit the content of the platform, in whole or in part, except as expressly permitted by the platform, subject to these Terms and Conditions.
- Engage in data mining or use robots, spiders, or other similar data collection and extraction tools on the platform.
Users will not have any permissions or access other than those allowed by the platform for the purposes of event management. Acceptance of these Terms and Conditions does not confer licenses or rights beyond the permissions and access granted by the platform, without the need for data manipulation maneuvers.
3.2. Acceptable Use Policy (AUP)
Clob users, including both event organizers and attendees, must comply with this Acceptable Use Policy (AUP). The following activities, industries, and goods are strictly prohibited:
- Illegal Activities: Organizing or promoting events that involve illegal activities, including but not limited to drug trafficking, human trafficking, or any activity prohibited by Chilean law or international laws.
- Fraudulent Ticket Sales: Engaging in fraudulent or misleading ticket sales, such as selling tickets for events that do not exist or are falsely represented.
- Adult Content: Organizing events that include explicit adult content or illegal adult services.
- Hate Speech and Discrimination: Events that promote hate speech, violence, or discrimination based on gender, race, religion, nationality, sexual orientation, or any other form of intolerance are not allowed.
- Intellectual Property Infringement: Selling tickets for events that infringe on the intellectual property rights of others, including the unauthorized use of copyrighted materials, trademarks, or logos.
- Unsafe or Dangerous Activities: Organizing events that encourage unsafe, violent, or dangerous activities, such as the illegal handling of weapons, violence, or activities that violate safety regulations.
Organizers and attendees who violate this policy may be removed from the platform, and Clob reserves the right to cancel events or take other actions as necessary.
4. User Accounts, Rights, and Content Responsibility.
By accepting these Terms and Conditions, you authorize Clob to use and process your personal data, whether sensitive or not, as well as your image for the following purposes:
- Storage of this information and its communication or shared use for study and statistical purposes, which may dissociate the information from your identity, for purposes of communication to the public and advertising, as long as such use adheres to the purposes of the Clob application or serves to promote it or publicize its activities.
- To process said data, including performing any operation or complex of operations or technical procedures, automated or otherwise, that allow the collection, storage, recording, organization, selection, extraction, confrontation, interconnection, dissociation, communication, transfer, transmission, or cancellation of personal data, or use it in any other form.
Both paid and free events, once accepted by users, generate a direct relationship between the user and the organizer for all purposes of legal responsibility. Consequently, by accepting these Terms and Conditions, you acknowledge that the Clob application is simply a space for contact between individuals who are responsible for their own actions, and Clob assumes no responsibility for the private acts in which users and organizers interact through the application.
By accepting these Terms and Conditions, users agree to:
- Provide accurate identification data.
- Respect the 'Anti-Corruption Norms' incorporated into the Chilean system, understood as any law, regulation, international treaty, and, in general, any legal norm aimed at preventing, combating, or sanctioning corruption, money laundering, bribery, and terrorism financing, including Law No. 20.393, which establishes the criminal liability of legal entities for money laundering, terrorism financing, and other crimes, or any legislation enacted to replace it.
- Respect the laws against drug and narcotics trafficking.
- The event organizer shall not engage in acts of arbitrary discrimination based on sex, lineage, condition, race, religion, beliefs, political ideology, nationality, sexual orientation, or any other act that contains or has a homophobic connotation in accordance with what is understood by such under the legislation in force at the time the event is uploaded to the application, promoted through it, and carried out. The event organizer assumes full responsibility for ensuring compliance with the above.
- The event attendee shall not engage in acts of arbitrary discrimination during the attendance at events based on sex, lineage, condition, race, religion, beliefs, political ideology, nationality, sexual orientation, or any other act that contains or has a homophobic connotation in accordance with what is understood by such under the legislation in force at the time the event is uploaded to the application, promoted through it, and carried out. The event organizer assumes full responsibility for ensuring compliance with the above.
- Assume full responsibility for uploading content that contains intellectual property rights of third parties without obtaining prior authorization.
5. Owner's Content, Rights, and Disclaimers of Liability.
All content on the Clob platform is owned by Bethere SpA.
The owner company reserves the right to alter and change its content, graphics, and sections at any time, remove spaces, and add or remove functionalities.
The owner company reserves the right to delete both users and content uploaded by such users without cause, and to block re-entry.
Clob will not be liable for any direct or indirect damages or any harm that may arise for the following reasons:
- Your access or use of the platform, or inability to access or use it.
- Any conduct or content submitted by third parties, whether or not they are registered users of Clob.
- Any content that has been extracted from the application or the loss of content, data, benefits, or revenue.
- Unauthorized access, use, or alteration of your transmissions or content.
- The realization of events or activities organized on the platform.
- The quality of events or activities.
- The thematic content of the events.
- The duration of the events, as well as their timely start and end.
- The suitability and quality of event venues and the safety of attendees.
- Whether event organizers comply with the applicable laws, regulations, circulars, ordinances, and standards.
- The suspension, postponement, or cancellation of events.
- Any act contrary to the law, regulations, circulars, and ordinances by event organizers before, during, or after events.
- The stability of the platform and any interruptions or loss of content that may occur due to updates or unauthorized actions by third parties.
- Payment platform failures, lack of information from such platforms, lack of payment receipts, or other omissions inherent to the payment platform used for transactions.
6. Intellectual Property.
All Content of Clob, including but not limited to texts, graphics, logos, icons, images, audio clips, digital downloads, and software, belongs to the owning company or its content providers and is protected by Chilean and international intellectual property laws.
7. Termination.
Clob reserves the right to modify, temporarily interrupt, or indefinitely terminate the Clob platform, with or without prior notice to users.
8. User Data Security and Privacy.
Clob ensures the security of the data entered into the platform and continuously reviews the mechanisms designed to protect and safeguard such data from third-party access, adopting reasonable security measures available in the market to protect your personal information against unauthorized access, misuse, alteration, or destruction. However, data breaches on websites present a challenge for which no responsibility is assumed for third-party actions that are impossible to foresee with new technical security measures.
9. Applicable Law.
These Terms and Conditions are governed by the laws of the Republic of Chile.
10. Payment Services.
The payment mechanism for event organizers will be carried out through accredited entities with recognized experience in the market, in accordance with the steps, stages, verifications, and security measures established by these entities, to which payment actions for the corresponding events through the Clob application will be referred.
11. Changes to these Terms and Conditions
The owning company reserves the right to modify these Terms & Conditions. The modifications will become effective upon being published on our application. We recommend reviewing these terms periodically to stay informed about any changes.
